Payment for Day Office Was Closed

Our retail store was open Sunday afternoon, Christmas Eve, and closed Christmas Day and the 26th. Do the employees (not salaried) get paid for the 26th? If so, is it at regular rate?

Hourly employees do not typically receive wages for hours not worked.

According to the US Department of Labor, "The Fair Labor Standards Act (FLSA) does not require payment for time not worked, such as vacations or holidays (federal or otherwise). These benefits are generally a matter of agreement between an employer and an employee (or the employee's representative)."

The last part of the statement, however, does indicate that some companies may offer holiday pay as extra compensation. Ownership MAY decide to pay your hourly employees if they so desire.
