Legally How Do I Need to Pay Employees on a Bi-weekly/80hour pay period.

If employees only work 30 hours the first week and 55 hours the next. Do I Only pay them 5 hours of overtime or do I have to pay 15 hours of overtime?

According to the Department of Labor, each week stands alone when figuring overtime. So even though the total number of hours for the two week period is 85, what counts is the 55 hours in one week.

So you will need to pay your employees 15 hours of overtime for the second week in the pay period.
