Can a Company Pay You After Your Set Pay Date?

My husband gets paid on the 5th and the 20th of the month. When either of these days falls on a holiday or a weekend, can they hold the check until the next business day? In Feb. the 5th is on Sunday, they told him he will not get paid until Monday. Is this legal?

Yours is a common question with monthly and semi-monthly payrolls, where the pay date falls on a weekend or holiday potentially a few times a year. Although it can make budgeting difficult, this practice IS allowed. A more accurate schedule for your husband should read: the pay dates for each month are on the 5th and the 20th, or the next business day if those fall on a non-business day. Sorry we can't give you the answer you would have liked.
